A Drug Enforcement Administration (DEA) judge denied a motion to remove the agency from its role in an upcoming marijuana rescheduling hearing, though he sharply criticized responses from DEA and a prohibitionist group over an allegation that they unlawfully communicated during the cannabis rulemaking process.
The judge noted there was “no indication in its [DEA’s response] that the Government has made even the mildest attempt to ascertain the truth and disclose it to the public and this tribunal.”
Monday Morning Quarterback
The DEA issued an advisory to notify the public about an initial hearing on the Biden administration’s cannabis rescheduling proposal that’s slated for next week.
The preliminary hearing on Monday, December 2 “will serve as a procedural day to address legal and logistical issues and discuss future dates for the evidentiary hearing on the merits. No witness testimony will be offered or received at this time.”
The DEA provided a link such that anyone can follow the proceedings remotely.

The wait is over for 74 applicants in Florida hoping to secure Medical Marijuana Treatment Center licenses. The state’s OMMU published the list of the 22 companies that received “letters of intent to approve” their license applications, and they will join a market where more than 700 MMTCs currently operate.
